Oishee’s death sentence commuted to life term

The High Court Division on Monday commuted death sentence of Oishee Rahman, 19, for killing her parents to life term. 
In 2013, she killed her father a police officer and her mother a company executive.
A bench of Justice Jahangir Hossain Selim and Justice Md Jahangir Hossain also imposed a fine of Tk 5,000 on Oishee or serve six more months’ jail in default.
The court directed the prison authorities to immediately shift Oishee from condemned cell to a cell for jail term servers.

The bench rejected her appeal seeking acquittal.
On November 12, 2015 Dhaka Speedy Trial Tribunal-3 sentenced Oishee to death with a fine of Tk 20,000 for killing her father Mahfuzur Rahman, then inspector of the Special Branch and her mother Swapna Rahman, then a company executive.
On the night of August 15,2013, Oishee had stabbed her parents after they took tea laced with sleeping pills she had given them.
To ensure their deaths Oishee slit their throats with kitchen knives and disappeared.
On the following morning, police recovered her parents’ bodies from their Chamelibagh residence.

Two days later, Oishee, then an ‘O-Level student’ surrendered to Paltan police station and admitted her crimes. 
In the observations, the High Court Division said it took five points into its consideration to commute Oishee’s death sentence. 
The verdict said that Oishee committed the double murder without any apparent motive as she was suffering from mental derailment or some sort of mental disorder together with ovarian cyst and bronchial asthma.
Citing evidence, it said that Oishee’s paternal grandmother and maternal uncle had a history of psychiatric disorders. 
The verdict said that Oishee was around 19-year old when she committed the murders which occurred immediately after she attained her majority.
The verdict also noted that Oishee had no history of significant previous criminal activity. 
The verdict said that Oishee had willingly surrendered to the police station two days’ after the murders.
Taking these factors into the consideration the court reduced Oishee’s death sentence to life term. 
The bench also stated in its observations that lesser punishment might prevent the crimes given good governance in a country and also awareness of the people. 
The court pointed out that it was evident that as Oishee was in the habit of taking psychoactive substances like shisha, alcohol, yaba and cannabis besides tobacco she was suffering from personal, mental and behavioral disorders as the doctors had certified. 
It also said that doctors found Oishee anxious and restless immediately after she committed the murders. 
In the verdict, the court observed that Oishee’s father being a police officer and her mother, a private service holder spent little time with their daughter.
