Human rights not established by writing words on paper: CJ

Chief justice Syed Mahmud Hossain said on Sunday that human rights were not established by writing words on paper or moving air with one’s lips.
He made the remarks at a discussion on ‘First Senior Advocate Ozair Farooq Memorial Law Conference’ organised by Dhaka University law faculty at the university.
He said, ‘It is the duty of the High Court Division to see that rights which are intended to be fundamental are kept fundamental and to see that neither the parliament nor the executive exceeds the bounds within which they are confined by the constitution and law of the land.’
The chief justice said that human rights were established by building specific types of institutions of quite exact design. 
‘Human rights are established further, when such institutions begin to live through organised, articulate, free, law-abiding interests through free association of every sort among a free people,’ he said.
He said that the constitution guaranteed certain inalienable rights considered all over the world as fundamental to liberty and dignity of individuals. 
He said that the High Court Division were empowered under the Article 102 of the constitution to issue directions or orders to protect the fundamental rights of the citizens. 
‘Moreover,’ the chief justice said, ‘The Appellate Division has extraordinary power to do complete justice in view of Article 104 of the constitution.’
