ENGLISH MEDIUM SCHOOLS Owners to pay VAT, not students: SC

The Supreme Court’s Appellate Division on Monday in a landmark decision directed the National Board of Revenue to collect value-added tax from the owners of English medium schools and not from the students.
A four-judge bench chaired by Chief Justice SK Sinha also allowed the NBR to appeal against a High Court Division verdict that had earlier declared VAT on students’ tuition fees of English medium schools as illegal and discriminatory.
On December 12, 2016, the High Court Division asked for abolishing the additional burden of VAT on the parents of students of English medium schools. 
A two-judge bench of Justice Zubayer Rahman Chowdhury and Justice Md Mozibur Rahman Miah gave the verdict after hearing a joint writ petition filed by Md Faizul Islam and Md Selim Azam, both aggrieved parents.
The petitioners had challenged the legality of imposing VAT on tuition fees of English medium schools.
SC lawyer AM Aminuddin appeared for the petitioners while deputy attorney general SM Moniruzzaman for the NBR.
