Judiciary not being allowed to function according to constitutional mandate: CJ

Chief Justice SK Sinha said Saturday that the judiciary was not being allowed to function according to constitutional mandate and the law.
He said that he had the firm belief that corruption, criminal tendencies and even terrorist activities could be curbed if the judiciary was allowed to properly exercise its powers as enshrined in the Constitution.
He told a discussion that crimes were on the rise because the judiciary was not allowed to play its due role. 
The discussion was hosted by the Bangladesh Judicial Service Commission to mark the inauguration of its Online Application Registration System in the capital.
The Chief Justice said that a quarter was creating division between the executive and the judiciary by wrongly briefing the head of the executive about the problems facing the judiciary.
He said that some lower ranking law ministry officials were misleading the executive to treat the judiciary as its adversaries.
He asked these officials not to provide wrong briefings to the head of the executive in future. He urged them to provide correct briefings in the interest of fostering harmonious relationship between the executive and the 
judiciary.
The Chief Justice said that the judiciary was never the executive’s adversary.
He said that such wrong briefing was harming the government and not the judiciary. 
He said that the Supreme Court was getting no response from the executive to its request for appointing 307 lower court judges including three district judges to fill vacant posts.
The inauguration was addressed by Appellate Division judge, Justice Md Abdul Wahhab Miah, Judicial Administration Training Institute’s director general Khondker Musa Khaled and its members Justice Quamrul Islam Siddiqui and attorney general Mahbubey Alam.
BJSC chairman and Appellate Division judge Justice Hasan Foez Siddique chaired the function held at the training institute.
