HSC ADMISSION GUIDELINES Govt asked to explain legality

The High Court Division on Tuesday directed the government to explain its guidelines for admission to Higher Secondary School Certificate class for the 2017-18 session would not be declared illegal.
The guidelines framed by the education ministry on May 7 require colleges to admit students in the HSC class on the basis of Secondary School Certificate Examination results.
The guidelines also made it mandatory for all the institutions to keep 89 per cent seats in the HSC class open to all the admission seekers.
The guidelines also require keeping 11 per cent of HSC seats reserved for various quotas, including five per cent for the children and grandchildren of freedom fighters.
The guidelines require keeping three per cent of the HSC seats for the candidates from outside the district towns and divisional cities, two per cent for the children of teachers, officers and employees of the education ministry and offices under it, 0.5 per cent for the students of BKSP and 0.5 per cent for foreign students.
The court stayed application of the education ministry’s HSC admission guidelines for Viqarunnisa Noon School & College.
A bench of Justice Salma Masud Chowdhury and Justice AKM Zahirul Haque gave the orders after hearing a public interest litigation writ petition of Supreme Court lawyer and governing body member of Viqarunnisa Noon College Eunus Ali Akond.
Education secretary and Dhaka education board chairman were asked to reply to the rules in four weeks. 
Later, assistant attorney general Arabinda Kumar Ray told New Age that the government will appeal against the stay order on application of the admission guidelines for Viqarunnisa Noon College.
The petitioner challenged the legality of the HSC admission guidelines for 2017-18 saying that the guidelines were issued by the government violating the Education Ordinance 1961 as well as the regulation adopted in 2009 under the law which empower college principals to admit students.
The petitioner also pointed out that the admission guidelines vested the authority of admission in HSC class in the education 
boards though the law says that the education boards would only hold SSC and HSC exams.
The petitioner pointed out that the guidelines by requiring the colleges to admit students in the HSC class following the serials determined by the education boards created a great scope of corruption.
The petitioner also pointed out that since Viqarunnisa Noon College has the obligation to admit students who passed the SSC Exam from Viqarunnisa School how the other candidates would be enrolled as the unrealistic guidelines require.
