JAILING PHYSICIAN IN LAKSHMIPUR ADC made OSD, summoned by HC

Additional deputy commissioner of Lakshmipur Sheikh Murshidul Islam was made officer on special duty at public administration ministry on Tuesday, a day after a mobile court jailed a physician, Salauddin Sharif, for three months on the allegation of assaulting the ADC.
Lakshmipur deputy commissioner Homayra Begum told New Age that she received the order in the evening. 
Earlier in the afternoon, the High Court summoned ADC and an executive magistrate to explain in person on December 13 why the physician was jailed by conducting a mobile court in personal interest.
The court also directed the government to explain why the proceedings of the mobile court that was conducted by executive magistrate Nuruzzaman on Monday in the personal interest of ADC Sheikh Murshidul Islam following a scuffle between him and former acting civil surgeon Salauddin Sharif would not be declared illegal.
On Tuesday, the court of additional district magistrate Mir Shawkat Ali granted Salauddin Sharif bail taking a bond of Tk 5,000 as he appealed against his sentence. 
The HC also asked the doctor to be present during the hearing on December 13. 
The respondents — secretaries of the ministries of home, law, and public administration, Lakshmipur deputy commissioner, additional deputy commissioner, the executive magistrate and the doctor — were asked to reply to the HC rule.
A bench of Justice Quazi Reza-Ul Hoque and Justice Mohammad Ullah passed the order after hearing a public interest litigation writ petition filed by two Supreme Court lawyers Kamal Hossain Meahzi and Ashfaqur Rahman.
The lawyers drew the court’s attention to different newspaper reports about the incident. 
The reports said that the mobile court was conducted at the deputy commissioner’s office for allegedly assaulting the ADC by the doctor following their scuffle at Kakoli Shishu Angan in the district town where they went to pick their sons during the office hours. The mobile court sent him to jail handing down the sentence. 
The High Court called such highhanded manner of the executive magistrate as ‘unfortunate’.
It recalled a case where Bhandaria Government College’s Assistant Professor Md Montaj Uddin was forced to apologise to an executive magistrate by holding his feet on orders from the local upazila nirbahi officer in Pirojpur on April 9, 2015.
Meanwhile, physicians and medical technologists of Lakshmipur General Hospital and other hospitals and clinics of the district town went for work abstention since morning and gathered on the deputy commissioner’s office premises in protest at the three-month imprisonment handed down to Salauddin. 
They, however, went to their workplaces after 1:00pm when the former acting civil surgeon was released on bail.
Meanwhile, Khulna unit of Prokrichi BCS Samanway Parishad, in a statement, condemned the sentence by a ‘so-called mobile court’ and expressed their dissatisfaction.
