Two accused in Zia Charitable case express no confidence in court

Two of the four accused in Shaheed Ziaur Rahman Charitable Trust case on Monday petitioned the Dhaka special judge’s court 5 to transfer the case to another court expressing no confidence in the court.
The judge, Akhtaruzzaman, then cancelled the bail of petitioner Ziaul Hoque Munna and posted for Tuesday the pronouncement of the order about the other petitioner Monirul Islam Khan.
The defence counsel moved the petitions after daylong argument on adjournment as they wanted to move to the High Court challenging the September 20 decision for continuing trial of the jailed Bangladesh Nationalist Party chairperson Khaleda Zia in the case in her absence.
As the court wanted to continue with the final arguments, the defence
counsel moved the petitions for transfer of the case ‘for the sake of justice’ fearing that ‘justice will not be done’ if Khaleda was tried in her absence.
At the beginning of Monday’s proceedings, Khaleda’s defence counsel Sanaullah Miah and Masud Ahmed Talukdar urged the court to arrange treatment for Khaleda and sought adjournment until her recovery.
They also informed the court that they would move to the High Court challenging Khaleda’s trial in her absence as she was in custody.
Anti-Corruption Commission prosecutor Musharraf Hossain Kajol said that he would seek a date for the verdict if the defence counsel were unwilling to continue the argument.
He earlier moved a petition for skipping the hearing of arguments stating that Khaleda was unwilling to appear in the makeshift courtroom inside the old Dhaka Central Jail.
Earlier on September 5, appearing in the makeshift court inside jail for the first time, Khaleda told the court, ‘There is no justice here. Punish me as much as you want, but I cannot appear here [the court] frequently as I am sick.’
The other accused, Abul Harris Chowdhury, the then prime minister Khaleda Zia’s political secretary, is being tried in his absence as he is still in hiding.
