HC stays sedition case against Khaleda

The High Court Division on Wednesday stayed the proceedings against former prime minister and BNP chairperson Khaleda Zia in a sedition case filed by a former ruling Awami League leader.
In the case, former AL central working committee member Momtaj Uddin Ahmed Mehedi alleged that Khaleda Zia raised controversy over the number of martyrs of the War of Independence and about the role of Sheikh Mujibur Rahman and AL in the Liberation War.
The court issued a rule asking the government and Momtaj Uddin Mehedi to explain why the decision taken by the Dhaka Metropolitan Sessions Judge’s Court on August 10, 2016 to take the case into cognizance would not be declared illegal.
The proceedings were stayed until disposal of the rule.
A bench of Justice Md Miftah Uddin Choudhury and Justice ANM Bashir Ullah passed the order after hearing a petition filed by Khaleda challenging the legality of taking cognizance into the case.
The government would appeal against the decision, deputy attorney general Moniruzzaman Kabir told New Age.
In January 2016, Momtaj also a Supreme Court lawyer, filed the sedition case against Khaleda with the Dhaka Chief Metropolitan Magistrates’ Court.
On January 21, 2016, the plaintiff got home ministry’s approval to file the sedition case against Khaleda.
Former attorney general AJ Mohammad Ali and Mahbub Uddin Khokon appeared for Khaleda Zia.
