The High Court Division on Tuesday upheld death sentences of four convicts, varying jail terms of five others but reduced life term to six months’ jail of yet another who were found guilty of murdering class four student Sheikh Md Samiul Alam Rajon by a trial court in Sylhet in November 2015.
The trial court had found the convicts guilty of trying to dump Rajon’s body after beating him to death at Jalalabad in Sylhet city, on July 8, 2015.
In the observation, the bench said that Rajon was subjected to inhuman and degrading torture by condemned convicts Qamrul Islam alias Qamrul, Tajuddin Ahmad alias Badal, Sadik Ahmed alias Bara Moyna and Zakir Hossain alias Pavel alias Raju.
Zakir still remains absconding.
The bench reduced life term of convict Noor Ahmed alias Noor Mia to six months’ jail as his offence was his failure to inform the police about the murder proceedings though he had recorded episode on his mobile camera and posted the footage on the social media.
It upheld seven years’ jail of Qamrul’s siblings Ali Haider Ali, Muhid Alam Muhid and Shamim Ahmed Shamim as well as local market’s night guard Sadik who were found guilty of attempting to dump Rajon’s body using a microbus.
The court upheld one years’ jail of Ayaz Ali, Dulal Ahmed and Sadik for supplying the ropes used to tie up Rajon on the wall Lalai Mia Market at Jalalabad.
Night guard Sadik was found guilty on three counts of the crime due his presence on all the crime scenes.
A bench of Justice Jahangir Hossain Selim and Justice Md Jahangir Hossain pronounced the verdict after confirming the death reference of the four condemned convicts and disposing of appeals of six other convicts who had challenged the verdict delivered by the Sylhet Metropolitan Sessions’ Judge’s Court on November 8, 2015.
The court said it found the video footage of the gruesome murder taken by Noor Ahmed as the evidence of crucial importance.
The bench said in the observations that Rajon’s hands were tied to his back and he felt thirsty Qamrul’s sweat was pushed in his mouth with the stick with which he was being beaten.
For demanding water, his tormentors humiliated Rajon and his mother and sister using filthy expressions.
No evidence was found by the bench that Rajon was murdered by the convicts for trying to steal a van parked at the Lalali Mia Market, assistant attorney general Md Atiqul Haq Selim told New Age after appearing for the state.
On July 8, 2015, Rajon, 13, the elder son of microbus driver Sheikh Md Azizur Rahman Alam died of multiple injuries on his body including vital parts inflicted by the convicts led by Qamrul.
Convict Qamrul on return from Saudi Arabia bought several shops in the Lalali Mia Market which the victim was done to death mercilessly.
Muhid was caught red-handed while he was making efforts to conceal the victim’s body while his brothers Haider and Shamim and night guard Sadik had decamped but they all were arrested later.
On July 9, 2015 Rajon’s father filed a case against Qamrul, his three brothers and seven other accused.
The video footage of the murder proceedings posted on the Facebook helped the police arrest the perpetrators.
Qamrul was arrested by the police in Saudi Arabia where he had fled two days after murdering Rajon.
On July 13, 2015, Qamrul was repatriated from Jeddah as the principal accused in Rajon’s murder.
