16th Amendment created scope for political victimisation of SC judges: CJ

The 16th Amendment had created a scope for political victimization of Supreme Court judges, Chief Justice SK Sinha said Tuesday while hearing the government’s appeal against the High Court Division verdict that had struck down the amendment.
All the seven judges of the apex court took part in the hearing chaired by the Chief Justice.
Ajmalul Hossain, who supported the controversial amendment completed his submissions in the morning. 
In the 2nd session, AJ Mohammad Ali and Fida M Kamal, as amicus curiae, supported the striking down of the 16th Amendment by the HC verdict. 
Out of 12 amicus curiae only two did not turn up while nine supported the HC verdict and Ajmal was the lone amicus curiae to support the 16th Amendment. 
The hearing for the 10th day took place in a packed court room as on the other days.
The hearing was adjourned until tomorrow, when attorney general Mahbubey Alam would reply to the amicus curiae. 
Former law minister Abdul Matin Khasru, MP, while making submissions as an intervener said that the 16th Amendment had restored the ‘original wordings of Article 96.’ 
The Chief Justice pointed out to the intervener that after 16 amendments the Constitution moved so far away from what it was on adoption in 1972 that became ‘A hotchpotch.’ 
Justice Md Abdul Wahab Miah said at this point there is no provision for restoration of any article of the Constitution.
He said Article 142 only provides for addition, alteration, substitution or repeal of any provision in the Constitution.
