16TH AMENDMENT VERDICT Govt files review petition later this month: law minister

Law minister Anisul Huq said Saturday that preparations were underway to file a petition later this month seeking review of Appellate Division’s July 3 verdict scrapping the 16th Amendment that empowered Parliament to remove Supreme Court judges for ‘misbehavior or incapacity’.
The government began making the preparations for filing the review petition after Chief Justice SK Sinha left the country, on what is believed to be forced leave.
The government drew severe criticism from all quarters for sending Chief Justice Sinha on forced leave as he penned the unanimous verdict that struck down the 16th Amendment.
So long Chief Justice Sinha was in charge, the government showed no interest to collect the verdict’s certified copy, needed to file the review petition. 
Sources in Attorney General’s office told New Age that the apex court’s 799-page full verdict posted on Supreme Court’s website was being studied for preparing the review petition.
The full verdict was posted on SC’s website on August 1.
The review petition would be filed within the stipulated 30 days from collection of the certified copy of the verdict, attorney general Mahbubey Alam told New Age after law minister Anisul Huq met him.
Anis told reporters that he met the attorney general to work out the legal grounds for seeking the review of the Appellate Division’s verdict.
He said that the review petition would be filed sometime this month.
