BGMEA BUILDING DEMOLITION Deadline extended again
The Appellate Division announced Tuesday that it would for the third time extend the deadline demolishing BGMEA’s illegal building on Hatirjeel Lake on production of undertaking that no further time would sought.
A four-judge bench led by Chief Justice Syed Mahmud Hossain kept its order pending saying, bring the undertaking we would give the order.
On Sunday the bench had announced that the order would be given on Tuesday.
The court allowed repeated postponement of demolition of the BGMEA Building since 2011.
The bench comprises, Justice Muhammad Imman Ali, Justice Hasan Foez Siddique and Justice Mirza Hussain Haider.
BGMEA’s lawyer Qamrul Haque Siddique took one day’s time to supply the undertaking.
On April 11 expires the 2nd deadline set by the Appellate Division for demolishing the illegal BGMEA structure.
On April 3, 2011, the High Court Division directed BGMEA to demolish its illegal building within 90 days.
‘At an emergency board meeting we took the decision to provide the undertaking on Wednesday,’
BGMEA president Siddiqur Rahman told reporters Tuesday afternoon.
BGMEA lawyer Qamrul Haque Siddique could not explain what steps were taken by the BGMEA in last one year since March 5, 2017 when the Appellate Division had rejected BGMEA’s review petition against demolition order.
Justice Mirza Hussain Haider told attorney general Mahbubey Alam, who appeared for RAJUK, ‘You demolished many buildings without giving time to the affected party to relocate.’
Justice Haider called it ‘unjust and unfair’ to allow the BGMEA to postpone the demolition of its illegal building time and again.
Chief Justice Syed Mahmud Hossain said ‘We feel ashamed over the way you are seeking time repeatedly.’
‘How many more times you would ask for time? Would it be for an indefinite period? You think that this court would provide the time you ask for,’ said Justice Syed Mahmud.
In 2016, the Appellate Division directed Rajuk to demolish BGMEA Building and realize the costs of demolition from BGMEA if it failed to do it within 90 days.
Since March 12, 2017, the Appellate Division extended the deadline for the demolition twice, once for six months and again for seven months. Such extension of deadlines by the Appellate Division after rejection of review petition was unprecedented, said lawyers.
The BGMEA already missed both the extended deadlines set by the Appellate Division.
