Govt fails to submit fresh report about Shahidul Alam to court

The High Court Division’s directive to the home secretary to submit a fresh report to the chief metropolitan magistrate’s court in the capital on Monday regarding whether or not acclaimed photographer Shahidul Alam was tortured physically and mentally in the custody of the Detective Branch was not complied with.
On Thursday a bench of Justice Syed Muhammad Dastagir Husain and Justice Md Iqbal Kabir asked the home secretary to submit the fresh report on Monday.
On Sunday Shahidul Alam was sent to Dhaka Central Jail by a metropolitan magistrate after he was produced by the DB after he was interrogated for the seventh day in remand.
When asked, Dhaka Central Jail’s senior superintendent Iqbal Kabir Chowdhury told NewAge on Monday night that no report was submitted to the CMM court through the jail about Shahidul Alam.
Appearing for Shahidul Alam at an Appellate Division hearing, Supreme Court lawyer Sara Hossain informed the court that the government did not comply with the directive of the High Court Division regarding his re-examination to determine whether or not he was tortured in custody.
Chief Justice Syed Mahmud Hossain who chaired the apex court’s bench advised her to raise the matter in the concerned court to get redress.
On Monday the Appellate Division dismissed a government petition seeking stay on the High Court Division’s first order to get Shahidul Alam examined by Bangabandhu Sheikh Mujib Medical University and provide his treatment there.
Attorney general Mahbubey Alam did not press the stay petition on the plea that the government had already complied with the first order asking it to provide Shahidul Alam’s treatment.
In the first report the government informed the High Court Division on August 9 that Sahidul Alam was in physically and mentally in sound health and also that no abnormalities were found on him.
Sara Hossain objected to the medical report as it was silent about whether or not Shahidul Alam was physically and mentally tortured.
Sara submitted that in his statement Shahidul Alam informed magistrate Asaduzzaman Noor that he was mercilessly tortured physically and mentally by the DB soon after he was picked up from his home.
