Jahalam freed at last

Jahalam who had been in jail custody since February 6, 2016 after being mistakenly identified as the accused in 26 corruption cases was released from Kashimpur Central Jail in Gazipur early Monday.
The jail superintendent Subrata Kumar Bala confirmed the news.
Earlier on Sunday, the HC directed the jail authorities to immediately set free 32-year-old innocent Jahalam.
A bench of Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader also acquitted the victim after Anti-Corruption Commission’s lawyer Khurshid Alam Khan admitted to the court that the ACC had made a mistake in the wrongful detention of Jahalam, a worker of Ghorasal Jute Mill in Narsingdi.
Jahalam was in the custody of Kashimpur Central Jail Part 2. He is from Dhubria, Sakin Nagar union, Tangail.
Subrata Kumar Bala told New Age Sunday evening that he would release Jahalam immediately after getting the court’s order that ‘is now on the way’.
The High Court bench rebuked ACC after its lawyer submitted that it made a mistake by arresting innocent person freeing real accused Abu Salek who was hiding in India after borrowing Tk 18.72 crore from the cantonment branch of state-owned Sonali Bank in 2010.
The court directed the ACC to inquire whether nor not it concocted a false story like ‘Joj Mia’ to implicate the innocent Jahalam to free the real accused in exchange for money.
The court came up with the remarks in presence of representatives from ACC and ministries of home and law who were summoned by the court earlier in suo moto ruling.
The bench set March 6 for passing further order on the matter.
The bench had passed the suo moto order taking into cognizance newspaper reports about the Jahalam’s wrongful detention which was brought to the notice of the court by Supreme Court lawyer Amit Das Gupta.
In April 2012, ACC’s the then deputy director Abdullah Al Zahid filed the case against Abu Salek who had taken the loan using Jahalam’s address.
Abu Salek worked as data entry staff at the National Identity Card Registration Wing of the Election Commission.
The miscarriage of justice was detected by National Human Right Commission on April 22, 2018 when its chairman met Jahalam inside Kashimpur Central Jail.
The case awaited trial by Special Court 6 in the capital.
