Swajan, BRTC equally liable, says HC

The High Court Division on Tuesday held Swajan Paribahan Limited and Bangladesh Road Transport Corporation equally liable for the death of government Titumir College student Rajib Hossain in a road crash near the Karwan Bazar crossing on April 3, 2018.
A bench of Justice JBM Hassan and Justice Md Khairul Alam while hearing a ruling which on April 4 had asked Swajan and BRTC to explain why they would not be directed to pay an equal amount of Tk one crore to Rajib, then under treatment. 
The bench adjourned the hearing until Tuesday. 
The ruling was issued after hearing a public interest litigation writ petition filed by Supreme Court lawyer Md Ruhul Quddus Kazal.
Rajib Hossain died on April 17, 2018.
The bench said that Swajan Paribahan Limited must take the vicarious liability for the fatal road crash.
The bench told the BRTC to take the responsibility of the fatal road crash as its driver had no license. 
On May 8, 2018 the High Court Division after hearing the writ petition, asked Swajan Pariibahan and BRTC to jointly pay Tk one crore to Rajib’s family.
The families are yet to get the compensation as Appellate Division in November 2018 stayed the High Court order and asked the High Court Division to dispose of the ruling on the Swajan and BRTC after assessing the liability of the road crash.
