MICHAEL CHAKMA’S DISAPPEARANCE HC asks for progress report on probe

The High Court on Tuesday asked the home ministry to submit a report to it in five weeks on the progress of investigation into whereabouts and disappearance of United Peoples Democratic Front leader Michael Chakma.
The bench of Justice Syed Refaat Ahmed and Justice Md Iqbal Kabir also asked the home secretary and nine others to explain in two weeks why they would not be directed to produce Michael Chakma before the court.
Other respondents include home ministry deputy secretary (security cell 3), the directors general of the Directorate General of Forces Intelligence, the Border Guard Bangladesh and the Rapid Action Battalion, the inspector general of police, the Dhaka Metropolitan Police commissioner, the superintendent of police in Narayanganj and the officer-in-charge of Sonargaon police station in Narayanganj.
The bench passed the order after hearing a writ petition of habeas corpus filed by Michael Chakma’s elder sister Suvadra Chakma.
Petitioner’s lawyer Jyotirmoy Barua argued that Michael Chakma remained untraced for 42 days since his disappearance from Narayaganj.
He submitted that law enforcers could in no way detain Michael Chakma in custody as the law and the constitution stipulated for producing an arrested person before a magistrate within 24 hours of the arrest.
He argued that the family suspected that Michael Chakma was held illegally in custody of government agency as his whereabouts was located at Kachukhet in Dhaka on April 15 after tracking his mobile call’s location.
According to a missing complaint filed with Sonargaon police station on April 16, the Chittagong Hill Tracts-based party leader of Rangamati started staying at Dhanakkha Chakma’s rented house at Kanchpur from March 27. 
On April 9, Michael left the house at about 4:00pm for Dhaka and said he would return by 10:00pm, but he never returned.
