HC asks Green Line to pay Tk 45 lakh to Russel by July 16

The High Court Division on Tuesday rebuked and ordered Green Line Paribahan owner Md Alauddin to pay the remaining Tk 45 lakh to accident victim Russel Sarkar in nine instalments by July 16.

Russel left leg was smashed by a speeding bus  of Green Line Paribahan at the Dolaipar end of Mayor Hanif Flyover in the capital on April 28, 2018.

The court ordered Green Line to pay Russel in instalments of Tk five lakh by the seventh day of each month.

Green Line was also ordered to submit a compliance report on July 16.   

The court warned that stern action would be taken against Green Line for noncompliance of the order.

The court said that it would see how the government protects non-compliant Green Line.

Green Line should not forget that Russel is also a driver and transport worker.

A bench of Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader issued the directive after rejecting Green Lines plea to reduce the  ‘exigency cost’ set for Russel.

The bench rebuked Green Line for  missing two deadlines set by the court to pay the remaining Tk 45 lakh after giving Russel a cheque for Tk five lakh in the courtroom on April 10.

The Appellate Division dismissed applications of the Bus Owners Association and Green Line seeking stay on the HC order.

On March 12,  2019 the High Court Division directed Green Line Paribahan to pay Tk 50 lakh to Russel Sarker by March 31 as ‘exigency cost’.

Earlier on May 14, 2018, the HC asked Green Line to explain why it would not be directed to pay Tk one crore to Russel as compensation.

Russel’s neighbour, Supreme Court lawyer and former MP Umme Kulsum Smrity filed the public interest litigation writ petition to advance his case.
