Ayesha freed on bail

The Barguna jail authorities on Tuesday afternoon freed Ayesha Siddiqua Minni on bail after she was detained for 50 days, 47 days in the jail and three days in Barguna Police Line, including one day was before she was arrested  and two days in  police custody for interrogations.

College student Ayesha, 19, has been detained in Barguna district jail since July 19, three days after the police detained her in the Barguna Police Line showing her arrested in the case of murdering her husband Rifat Sharif at Barguna on June 26.

‘She has been handed over to her father Mozzammel Hossain Kishore at the jail gate at about 4.30PM,’ Barguna district jail superintendent Anwar Hossain told New Age.

Her father was asked to come to the jail gate to receive her and keep her in his custody.

In an ambulance, Ayesha accompanied by her father, brother and an uncle headed to her village, Nayakata Police Line, Barguna district town.  

On Tuesday morning Barguna judicial magistrate M Zahid Hasan received the copy of her bail order issued the High Court Division on Thursday and later issued her release order.

On Monday the Appellate Division refused to stay Ayesha’s bail.

Vacation judge, Justice Hasan Foez Siddique refused to stay her bail after briefly hearing the government’s provisional application for leave to appeal against the bail granted to her by the High Court Division for illegally interrogating and arresting her and also taking her into police custody for further interrogations without giving her the opportunity to engage lawyer to defend her.

The SP of Barguna also illegally said at a press conference that Ayesha had confessed to him  that she was involved with her husband’s murder.

The SP’s allegation influenced the subsequent investigations against her about her fabricated and alleged involvement with the murder.

She was illegally forced to give statement about her alleged involvement with the murder to a magistrate in Barguna without giving the opportunity to engage a lawyer as the law stipulates.

On Sunday, Barguna police pressed murder charge against Ayesha and 23 other accused although she was the witness number one in the murder case filed by her father-in-law Dulal Sharif.

The name of prime murder accuse Sabbir Ahmed alias Nayan Bond was dropped from the charge sheet as he was killed in ‘gunfight with the police on July 2’  while nine other accused are yet to be arrested.

Rifat Sharif was hacked to death in broad daylight by the criminals in front of Barguna Govt College with his wife Ayesha resisting the murderers all alone, the incident went viral.

On the night of July 16, police arrested Ayesha after daylong interrogations by the SP of Barguna at the police line and on the next day, a local magistrate allowed the police to take her into their custody for five days for further interrogations.

Ayesha was not allowed to consult her lawyers during the interrogations by the SP or at the remand hearing and the subsequent interrogations for five days in police custody.

Supreme Court lawyer ZI Khan Panna, also chairman of Ain O Salish Kendra, with Supreme Court Bar Association president AM Amin Uddin appeared for Ayesha.
